Most often, the parents work together
to make decisions about their children. If the parents can not agree,
the parties will apply to Court and a judge will decide.
The factors a Court will look
at in making its decision can include:
(1) the history of care for the child;
(2) the child’s physical, psychological, and emotional needs;
(3) the nature and strength of the relationship between the child
and other people residing in the child’s household; and
(4) the ability and willingness of each the parents to care for and
meet the needs of the child.
